A Federal High Court in Abuja could not hear a motion filed by a former Minister of the FCT, Malam Nasir el-Rufai against the Attorney General of Federation (AGF) and the Inspector General of Police (IGP) to stop his arrest.

Counsel to el-Rufai, Mr Anthony Itedjere, had brought a motion on notice before the court to restrain the defendants from arresting, detaining or prosecuting his client.

The court could not hear the motion because the AGF, Mr Michael Andoakaa (SAN) was absent in court.

el-Rufai is praying the court to hold that the defendants should not arrest or prosecute him.

He hinged his prayer on the recommendations of the Joint Committee of the Senate on FCT and Housing, which are subjects of judicial proceedings at the Federal High Court.

Itedjere told the court that he was informed that the counsel handling the case from the Ministry of Justice, Mr Anthony Malik, could not be present in court on health grounds.

"The AGF’s office informed us that the counsel handling this matter is not feeling fine and that he will not come, they advised us to take a fresh date for hearing.

"The originating summon has been served on the IG but his office refused the service on the grounds that they have less than 48 hours for the hearing of the case.

"Before now, we have properly served them and left the processes with one of the officers in the IG’s office but they threatened to arrest us," he said.

Justice Gabriel Kolawole adjourned the matter to April 15 and ordered the applicant to serve the processes on all the defendants before the hearing date.
